Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of the Foxx River Autos website, mobile pages, and car-rental services (collectively, the “Services”). By visiting our site, making a booking, or using our vehicles, you agree to these Terms.

1) Who May Use the Services (Eligibility)

You must hold a valid, government-issued driving licence that is accepted in Nigeria and suitable for the vehicle rented.
You must pass our digital ID verification and any security checks we reasonably require.
Additional drivers must be registered and verified before pickup.

2) Your Account & Verification

Keep your account details accurate and secure.
We may request extra documents at any time (e.g., proof of address, ID, payment card verification).
We may refuse, cancel, or suspend a booking if information is false, incomplete, or cannot be verified.

3) Bookings & Contract Formation

A booking is an offer to rent a vehicle. The contract forms only when we send a Booking Confirmation.
Vehicle category is guaranteed; specific models are subject to availability.
If your category is unavailable, we may provide an equal or higher category at no extra cost.

4) Prices, Deposits & Payments

Daily rates and fees are shown at the time of booking.
Refundable security deposit: ₦80,000–₦150,000 (depends on the vehicle).
Payment methods are those shown at checkout or at pickup.
Charges may include: rental rate, VAT/taxes (where applicable), optional extras, fuel, tolls/fines, late fees, cleaning/valeting fees, and damage charges (see Section 10).

5) Cancellations, Changes & No-Shows

You may cancel or change a booking according to the rules shown at checkout and on your confirmation email.
If you do not arrive within the grace period in your confirmation (no-show), the booking may be cancelled and fees may apply.

6) Pickup Requirements

Bring your original driving licence, the payment card used for booking, and a valid government ID.
Name on the card must match the main driver.
We will inspect the vehicle with you and note any pre-existing damage on the Vehicle Condition Report.
You will sign the Rental Agreement, which forms part of these Terms.

7) During Your Rental (Your Responsibilities)

You agree to:

Use the vehicle carefully and lawfully, following road rules.
Keep to the agreed mileage/area of use stated in your Rental Agreement.
Lock the vehicle when unattended and keep keys secure.
Use the correct fuel and maintain normal care (e.g., tyre pressure, oil/temperature alerts).
Pay for fuel used and any fines, penalties, tolls, or charges during the rental.

8) Prohibited Uses

Drive under the influence of alcohol, drugs, or other impairing substances.
Use the vehicle for racing, off-road driving, towing, carrying passengers for hire, or unlawful purposes.
Permit unapproved drivers to operate the vehicle.
Tamper with odometers, trackers, or safety systems.
Take the vehicle outside Nigeria without our written consent.

9) Breakdown & Roadside Assistance

Free breakdown support is included. Contact the number in your Rental Agreement.
Assistance for driver-error events (e.g., wrong fuel, lost keys, flat battery due to lights left on) may attract a service charge.

10) Loss, Damage & Insurance

You are responsible for loss or damage to the vehicle up to the amount stated in your Rental Agreement, except where coverage applies.
Report accidents, theft, or damage to us immediately and obtain a police report where required.
Do not admit liability or settle claims with third parties without our consent.
We may deduct amounts owed (e.g., excess/deductible, fines, cleaning) from your deposit or payment method after providing a statement of charges.

11) Returning the Vehicle

Return the vehicle at the agreed time and location, with the same fuel level noted at pickup.
Late returns may be charged at the then-current daily rate plus any additional fees.
Extensions must be approved before the return time; extra days are billed at the applicable rate.
Extra cleaning (including smoke/odour removal) may incur a valeting fee.

12) Website & Content Use

The site and its content are owned by Foxx River Autos or our licensors (see Copyright Notice).
You may not copy, scrape, or republish content without written permission.
We may change or remove pages, features, or content at any time.

13) Privacy

Your personal data is handled as described in our Privacy Notice.
By using our Services, you consent to that processing.

14) Warranties & Disclaimers

We provide the Services using reasonable skill and care but do not guarantee uninterrupted availability.
Except as required by law, we disclaim implied warranties regarding the site and Services.

15) Liability Limit

To the maximum extent permitted by law, Foxx River Autos is not liable for indirect, incidental, special, or consequential losses.
Our total liability for claims relating to a rental is limited to the amounts paid by you for that rental, except where law does not allow such a limit.

16) Indemnity

You agree to indemnify and hold Foxx River Autos harmless from claims, fines, penalties, damages, and costs arising from your breach of these Terms or unlawful use of the vehicle.

17) Changes to These Terms

We may update these Terms from time to time. The updated version applies from the date it is posted on this page.

18) Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria.
Disputes will be subject to the jurisdiction of the courts of Nigeria.
